1. Acceptance of Terms

By accessing and using brwnze.com ("Site"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these Terms of Service ("Terms"), do not use this Site. Your continued use of the Site following any modifications to these Terms constitutes your acceptance of those changes.

2. Age Restriction

This Site contains adult content and is strictly intended for adults aged 18 years or older. 3.5 Communications

By creating an account, you agree to receive transactional emails necessary for the operation and security of your account. These include account verification upon registration, password reset requests, password change confirmations, and email address change confirmations. We do not send newsletters, promotional materials, or marketing communications of any kind.

4. User Content

4.1 Content Upload

Users may upload video content to the Site subject to our review and approval process. By uploading content, you represent and warrant that:

  • You own all rights to the content or have obtained all necessary permissions from every rights holder
  • The content does not violate any applicable laws or regulations
  • The content does not infringe upon the intellectual property rights of any third party
  • All individuals appearing in the content are at least 18 years of age and have provided their prior, informed, and freely given consent to appear in and be distributed as part of such content
  • You have documentation of age verification and consent for all performers upon request

4.2 Content License

By uploading content to the Site, you grant Brwnze a worldwide, non-exclusive, royalty-free license to use, reproduce, distribute, display, and perform the content solely in connection with operating and providing the Site. This license does not transfer ownership of your content. You retain all underlying intellectual property rights in content you upload.

4.3 Content Removal

We reserve the right to remove, disable, or restrict access to any content at any time, for any reason, without prior notice. This includes content that we determine, in our sole discretion, violates these Terms, applicable law, or the rights of any third party. Removal of content does not entitle you to any compensation or refund.

4.4 Content Review

All uploaded content is subject to review and approval before it becomes publicly accessible. We do not guarantee that submitted content will be approved or published. We are not obligated to review all content and do not assume editorial responsibility for user-submitted material.

5. Prohibited Conduct

You agree not to engage in any of the following:

  • Uploading, posting, or transmitting any content that depicts minors or could reasonably be interpreted as depicting minors, regardless of whether it is real or fictional
  • Uploading or distributing non-consensual intimate imagery (NCII), commonly known as "revenge porn," or any content depicting a real person without their explicit consent
  • Uploading content that you do not own or have the rights to distribute
  • Creating multiple accounts or circumventing any account ban or suspension
  • Violating any local, state, national, or international law or regulation
  • Infringing the intellectual property rights of others
  • Transmitting any viruses, malware, spyware, or other malicious or harmful code
  • Attempting to gain unauthorized access to any portion of the Site, its infrastructure, or the accounts of other users
  • Harassing, threatening, defaming, or otherwise harming other users
  • Using the Site for any commercial purpose, including advertising or solicitation, without our express written consent
  • Scraping, spidering, crawling, or using any automated means to access, collect, or index content from the Site
  • Impersonating any person or entity, or misrepresenting your affiliation with any person or entity
  • Interfering with or disrupting the integrity or performance of the Site or its infrastructure

6. DMCA and Copyright Complaints

Brwnze respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA). If you believe that content on the Site infringes your copyright, you may submit a takedown request through our DMCA complaint form. Your notice must include all information required under 17 U.S.C. § 512(c)(3), including identification of the copyrighted work, the allegedly infringing URL, your contact information, a good faith statement, and a statement made under penalty of perjury that the information in your notice is accurate.

We will respond to valid DMCA notices by removing or disabling access to the allegedly infringing content. Repeat infringers may have their accounts terminated.

If you believe content was removed as a result of mistake or misidentification, you may submit a counter-notice in accordance with 17 U.S.C. § 512(g). Please contact us at the address in Section 14 for counter-notice procedures.

7. Privacy

Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Site, you consent to the data practices described in the Privacy Policy. The Privacy Policy explains what information we collect, how we use it, and what rights you have with respect to your personal data.

8. Intellectual Property

The Site and its contents, features, and functionality — including but not limited to its software, design, text, graphics, and the selection and arrangement thereof — are owned by Brwnze and are protected by copyright, trademark, and other applicable intellectual property laws. Nothing in these Terms grants you any right, title, or interest in the Site or its proprietary content other than the limited license to use the Site in accordance with these Terms.

9. Disclaimer of Warranties

THE SITE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, FREE OF ERRORS OR VIRUSES, OR THAT ANY DEFECTS WILL BE CORRECTED. YOUR USE OF THE SITE IS AT YOUR SOLE RISK.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BRWNZE AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF (OR INABILITY TO USE) THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU HAVE PAID US IN THE PAST SIX MONTHS.

11. Indemnification

You agree to indemnify, defend, and hold harmless Brwnze and its operators, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of or access to the Site; (b) your violation of these Terms; (c) any content you upload or submit to the Site; or (d) your violation of any rights of another party, including intellectual property rights.

12. Dispute Resolution

Any dispute, claim, or controversy arising out of or relating to these Terms or the use of the Site shall first be addressed by contacting us directly at the address in Section 14. We will make a good-faith effort to resolve disputes informally before any formal proceedings. If informal resolution is not possible, disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules, except that either party may seek injunctive or equitable relief in a court of competent jurisdiction to prevent irreparable harm. Class action waiver: to the extent permitted by law, you waive any right to bring or participate in any class action lawsuit against us.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page. For significant changes, we may also provide notice through the Site or via email to registered users. Your continued use of the Site after such modifications constitutes your acceptance of the updated Terms. If you do not agree to the revised Terms, you must stop using the Site.
